These terms of sale (the “Terms of Sale”) govern the sale of the subscriptions offered by SmartZonesIndicators (the “Publisher”) inside the Frigd mobile app, distributed on Apple's App Store and on Google Play.
Any subscription implies unreserved acceptance of these Terms of Sale. They supplement the terms of use and the privacy policy.
Access to Frigd is entirely paid, after a free trial: there is no limited free version, and the app is funded by no advertising. All features are included in each of the three plans — they differ only in their duration and their price.
The three plans belong to a single subscription group, on the App Store as on Google Play:

Prices are shown in euros, all taxes included, for the euro area. They may vary depending on the country and the currency of your App Store or Google Play account; the exact price applicable to your account is shown to you by the store before any purchase is confirmed. The Publisher reserves the right to change its prices; any change has no effect on periods already paid for and is notified to you by Apple or by Google under the conditions laid down by the store concerned.
Every first subscription gives the right to a free trial: three (3) days for the monthly plan, seven (7) days for the 6-month and 12-month plans. During the trial, access is complete and no amount is charged.
A single subscription covers the whole household.
This arrangement is specific to Frigd and works independently of Apple's “Family Sharing”.
The sale, collection of payment and invoicing are handled exclusively by the app store — Apple through the App Store, or Google through Google Play. Payment is charged to the user's App Store or Google Play account when the purchase is confirmed, and then at each renewal.
The Publisher has no access to any banking data: it does not collect, process or store any card number or payment details. Purchase receipts are issued by Apple or by Google and can be viewed from your App Store or Google Play account.
There is no other sales channel: no online shop, and no card payment outside the App Store and Google Play.
Automatic renewal. The subscription renews by tacit agreement for an identical duration, at the price then in force, unless cancelled at least 24 hours before the end of the current period. Payment is taken within the 24 hours preceding the end of the period.
Change of plan. Subscribers may switch from one plan to another from the management of their App Store or Google Play subscription, which the app opens from Profile. As the three plans belong to a single subscription group, the change is not a new purchase and does not give a new right to the free trial. Its effective date (immediate, or at the next renewal) and the price applied follow the store's rules, which the store shows you before any confirmation.
The subscription can be cancelled at any time, without reason and free of charge, from your device settings:
On iPhone: Settings › your name › Subscriptions › Frigd › Cancel Subscription.
On Android: Google Play › Account menu › Payments and subscriptions › Subscriptions › Frigd › Cancel subscription.
Cancellation must take place at least 24 hours before the renewal date to avoid the next renewal. It takes effect at the end of the current billing period: access remains open until that date, with no pro-rata refund.
As cancellation takes place with Apple or Google, the Publisher can neither perform it nor bring it forward on your behalf. Uninstalling the app does not amount to cancellation.
In accordance with article L. 221-28 13° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose performance has begun with the consumer's prior express consent and their express waiver of their right of withdrawal.
By subscribing, the user expressly requests immediate performance of the service — access to the app is opened as soon as the purchase is confirmed — and expressly waives their right of withdrawal.
The free trial makes it possible in practice to try out the entire service before any payment is taken.
Refunds are handled exclusively by the store that sold you the subscription. For a purchase on the App Store, the request is made from reportaproblem.apple.com or from your purchase history; for a purchase on Google Play, from your Google Play order history. The Publisher has no power to grant, refuse or carry out a refund.
In case of a technical fault attributable to the service and depriving you of access, write to us: we will support your request with Apple or Google.
The service is provided with the benefit of the legal guarantee of conformity of articles L. 224-25-12 et seq. of the French Consumer Code, applicable to digital content and services. In case of a lack of conformity, you may require the service to be brought into conformity and, failing that, obtain a price reduction or the termination of the contract, under the conditions laid down by law.
These guarantees apply independently of these Terms of Sale and at no cost to the consumer.

In accordance with article L. 616-1 of the French Consumer Code, in case of a dispute not resolved by a prior written complaint to our customer service, the consumer may use a consumer mediator free of charge.
These Terms of Sale are subject to French law. Failing an amicable resolution, the French courts have jurisdiction. The mandatory protective provisions of the consumer's country of residence remain applicable.
